Nashville Short-Term Rental Regulations

City Code of Ordinances

There are two types of Short Term Rental Property permits in Nashville: owner-occupied and not owner-occupied. New, not owner-occupied STRP licenses (typically owned by investors) are only allowed in particular non-residentially zoned locations, as indicated in the District Land Use TableOwner-occupied means an owner-occupied residential dwelling unit containing not more than four sleeping rooms that are used and/or advertised through an online marketplace for rent for transient occupancy by guests. The property owner must either continuously or permanently reside in the property. The property's owner must be a natural person or persons, not a limited liability entity, such as a corporation or limited liability company, and not an unincorporated entity, such as a partnership, joint venture, or trust.  Not owner-occupied means a residential dwelling unit that is not owner-occupied containing not more than four sleeping rooms that are used and/or advertised through an online marketplace for rent for transient occupancy by guests. The maximum number of occupants permitted at any one time for owner-occupied and not owner-occupied shall not exceed more than twice the number of sleeping rooms plus four. Business License Requirements

The application for a Short Term Rental Property permit involves several steps. These are the checklist for the two types of short term rental property:The Nashville Fire Marshal's office will no longer conduct inspections on single and two-family residences as of March 1, 2022. Instead, applications for short-term rental permits in these residences must include a certificate from a state-licensed architect, engineer, or home inspector stating that the home complies with Metropolitan Code of Laws 6.28.030.A.5.b and 6.28.030.B.5.b. See New Permit Requirements and Steps for more information. 

Building and Housing Standards

Nashville has rules and regulations that specify minimum building, design, maintenance standards, habitability, health, and safety requirements. Tourist and Local Taxes

All sales and hotel taxes must be remitted to the appropriate agency by the Short Term Rental Property operator: Visit the Office of the Treasurer to learn more about tax payments.
